What personal data we collect and why we collect it

If you choose to correspond with us through email or Whatsapp, we may retain the content of your messages together with your email address/cellphone number and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received online, mail and telephone.

uPhil does not have a signup form. Therefore we do not use cookies to store your session variables. This may change in the future.

IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer. IP addresses are automatically collected by our web server as part of demographic and profile data known as “traffic data” so that data (such as the Web pages you request) can be sent to you.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

When using uPhil your data will be used by us and us alone to analyze our website and the general user experience. Data is also used to track the amount of users and total tips.

Broadly speaking, we use personal information for purposes of administering our business activities, providing customer service and making available other items and services to our customers and prospective customers.

Your information is therefore only shared with service providing companies contracted by us. These include but are not limited to the plugins we use to administer this website (PWA for WP, WordPress, Oxygen builder, Custom Functions and Analytics)

uPhil will not obtain personally-identifying information about you when you visit our site, “www.uPhil.co.za” when you choose to provide such information to us, nor will such information be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection.

We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or for the protection of our legal rights.

You can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

We are committed to keeping your e-mail address and other contact information confidential. We do not sell, rent, or lease personal data to third parties, and we will not provide your personal information to any third party individual, government agency, or company at any time unless we’re strictly compelled to do so by law.

We will use your contact information solely to provide timely information about uPhil.

We will maintain the information you send via personal means (email, WhatsApp etc.) in accordance with applicable federal law.

Email is not recognized as a secure medium of communication. For this reason, we request that you do not send private information to us by email. We will therefore never ask you to send sensitive information via any electronic. However, doing so is allowed, but at your own risk. Some of the information you may enter on our website may be transmitted securely via a secure medium known as Secure Sockets Layer, or SSL. Credit Card information and other sensitive information is never transmitted via email.

uPhil may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas. For site security purposes and to ensure that this service remains available to all users, uPhil uses software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

We only receive data from our own social media platforms. These include, but are not limited to, Facebook, Instagram and YouTube. We only collect data from our own personal profiles.

We may use your data for social media advertising targeting for our own products.

In accordance to with the FTC guidelines concerning the use of endorsements and testimonials in advertising, please be aware of the following:

They are individual experiences, reflecting real-life experiences of those who have used our products and/or services in some way. They are individual results and results do vary. uPhil will only communicate with clients in two ways (unless replying to an email or Whatsapp).
1. In app messages through Zapper (see zapper.co.za)
2. In app messages through uPhil

Each receiver will get an SMS and a WhatsApp from uPhil at the end of the day, after they’ve received their first tip. This message is purely sent to provide information about uPhil and their funds.

Receivers are then paid out to a money market account with Shoprite, every Friday. At which point they will receive a message from Shoprite with information about the money market account and their current balance. See shoprite.co.za.

When tipping on uPhil, you are required to enter the receivers cellphone number. The total tip amounts for each cellphone number is determined by a programme and an Excel spreadsheet is sent to Shoprite. Shoprite then uses the receivers cellphone number to send them their money, to be spent at any Shoprite outlet. The receivers cellphone number is not used by us for marketing in any way. We do not share the receivers cellphone number with anyone other than Shoprite. We are not responsible for how Shoprite decides to use the receivers cellphone numbers.

This website is governed by the laws of South Africa and uPhil chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

In compliance with the CAN-SPAM Act, all emails and messages sent from uPhil will clearly state who the message is from and provide clear information on how to contact the sender. 

All messages sent from uPhil will be in the form of “in app messaging” whether through uPhil or Zapper. To opt out of these messages, the user simply has to turn of notifications in their phones settings.

It is your own responsibility to ensure that the emails received from uPhil are not sent to your Spam box. If an email from uPhil ends up in your spam box it is in your best interest to “mark as not spam” to prevent this from happening in the future.

Although we try our very best to respond to each and every email and WhatsApp as soon as possible – it is not always the case. We will always attempt to reply within a maximum of 2 business days. If you haven’t received any feedback from us within this time – please do not hesitate to contact us again.

Please note that our WhatsApp number is a data number only. You can not call us on this number. Furthermore – we do not accept WhatsApp calls. Only contact us via email or WhatsApp messaging.

The above excludes any content marked as “Free”. Free content can be shared and may be downloaded if, and only if, a download link is provided. You may therefore not download any content if a third party product is needed to do so.

Zapper charges a small fee of 2.5% – 3% (already added to the tip amount). This covers their costs. This commission fee may change without notice. We charge a tiny 1.5% when tips are paid out – this is our personal commission.

Payments are handled by 3rd parties. Currently Zapper is supported (with OZOW and MasterPass coming soon). Therefore a user is required to sign up with Zapper before they can use uPhil to tip.

All transactions are processed externally by Zapper. Users may go to www.zapper.co.za to view their security certificate and security policy.

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

You agree to use our website only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website.

You must not use our website to send unsolicited commercial communications. You must not use the content on our website for any marketing related purpose without our express written consent.

We may in the future need to restrict access to parts (or all) of our website and reserve full rights to do so.
